Complaint against collectors to the NBU, the police, the court – help in filing a complaint against a collection company

Reading time: 3 min.

Collection companies have become an indispensable component of the modern financial market. They are engaged in debt collection from debtors who have not paid their debts for loans, credits or other financial services. However, the actions of collectors often cross the line of legality, so many people turn to the National Bank of Ukraine, the police and the court for protection.

In this article, we will consider how to properly file a complaint against collectors and how to protect your rights in the event that collectors violate the law.

What to do if collectors violated your rights?

First of all, it is important to determine exactly which rights were violated by the collectors. For example, the collector may demand debt repayment in an illegal way, use fraudulent methods or seek to fulfill obligations in an unpleasant way.

After you have realized that your rights have been violated, you can seek help from the following authorities:

  1. National Bank of Ukraine. If the collector violates the requirements of the law, you can appeal to the National Bank of Ukraine with a complaint. It is important to note that the Bank does not have the authority to resolve disputes between collectors and debtors, however, in case of violations by collectors, the Bank may impose fines and impose other sanctions on collection companies.
  2. Police. If the collector has committed a crime, such as fraud, threats, physical or psychological abuse, you have the right to contact the police with a complaint and statement about the criminal activity of the collectors. After you have contacted the police, you should provide evidence and testimony that confirms the violation of rights. The police will conduct an investigation and take the necessary measures to bring the guilty parties to justice.
  3. Court. If your rights have been violated by collectors, you have the right to file a lawsuit to protect your rights. Evidence of violation of rights should be presented in court, as well as objections to the claims of collectors. After consideration of the case by the court, fines may be imposed on the collection company or the guilty persons, and a decision on compensation for damages caused by the violation of rights is also issued.
