COMMUNICATIONS ABOUT SIGNIFICANT CHANGES IN THE PROPERTY SITUATION. CURRENT ISSUES

 The current anti-corruption legislation provides for many measures that are aimed at eliminating corruption in the public sphere. One of such measures, namely a financial control measure, is a notification of significant changes in property status.

 If a person has received income, acquired property or incurred expenses in the amount of more than 50 PM, then he must submit a corresponding message to the National Agency for Preventing Corruption within 10 days from the date of the specified actions.

 Each person who is obliged to inform the National Agency for Preventing Corruption about such significant changes in the property status must know certain features associated with such a message. The declaring entities who submit such messages for the first time have many questions. We will try to answer the most relevant ones.

 An incomplete understanding of the intricacies of this message can lead to negative consequences, including  - bringing to administrative responsibility.

⟪ Who should inform the National Agency for Preventing Corruption about the relevant changes in the property status? ⟫

 The legislator has narrowed the circle of these subjects, and now such messages should be filled out only by those persons who are officials and at the same time occupy a responsible and especially responsible position. This category of persons also includes authorized entities holding positions associated with a high level of corruption risks. The list of specific positions is already determined by the bylaws of the National Agency for Preventing Corruption.

⟪ Do I need to report significant changes in the property status of a family member or other related persons? ⟫

 This issue is due to the fact that when filling out an electronic declaration, it is required to indicate information about the property, income of their family members. However, there is no such obligation when filling out the corresponding message.

⟪ Have you purchased a car abroad? When exactly is it necessary to submit a corresponding message to National Agency for Preventing Corruption ⟫

 If a person buys or otherwise acquires a vehicle on the basis of a civil law transaction in foreign countries, which is confirmed by the relevant documents, in the absence of state registration of this vehicle, then this person is subject to the requirements of the legislation on the need to report significant changes in property status. The person must fulfill this obligation within 10 days from the moment of acquiring the ownership of the car on the basis of the contract and provided that the value of this vehicle exceeds 50 PM. Any costs, including the costs of paying taxes, fees and other mandatory payments, paid in connection with the import of such a car into the customs territory of Ukraine and its state registration, should not be taken into account when calculating the value of the property in respect of which it is necessary to submit messages.
