COMMISSIONING OF THE BUILDING. BUILDING AMNESTY
Situations often arise when citizens, in their lack of awareness or self-confidence, commit actions that do not fully comply with the norms of the law. For example, having owned a plot of land, they believe that they can do anything on it, including construction. But having built a house without permits, they face the problem of its legalization, i.e. putting it into operation, connecting the property to communications, etc. Then the question arises, how to legalize a house built without the necessary permits?
Among the possibilities of legalizing construction is the so-called "construction amnesty". That is, it means putting the house into operation without permits without any penalties for the owner.
The construction amnesty is regulated by the Order of the Ministry of Community and Territorial Development № 158 dated August 31, 2018.
Which buildings are subject to construction amnesty?
Residential buildings and other economic structures, which were built without appropriate permits in the period from August 1992 to April 2015. But the total area of such buildings should not exceed 300 square meters. Also, one of the mandatory conditions for the construction amnesty is that the houses must be built on a plot of land with an appropriate purpose. That is, the intended purpose of the land plot should be "for the construction and maintenance of residential buildings." If the target purpose is different, for example "for gardening", it is not possible to use the construction amnesty.
Where to apply?
To use the construction amnesty, you need to contact the State Inspection of Architecture and Urban Planning. This can be done through centers for the provision of administrative services (TsNAP), contact the DIAM in person or send documents by mail, or with the help of the DIIA electronic portal.
Necessary documents for putting the house into operation under construction amnesty
- completed application;
- duly certified copies of documents confirming ownership of the land plot;
- technical passport for the house;
- a completed declaration on the readiness of the house for operation.
Review period
DIAM considers the application with the submitted documents about the acceptance of the building into operation with the application of construction amnesty within 10 working days from the day of its receipt.
Cost of construction amnesty
As of 2022, putting a house into operation under construction amnesty is a free procedure. No duties or administrative fees are payable.
