COMMISSIONING OF REAL ESTATE FACILITIES DURING THE EFFECT OF MARTIAL STATUS

After a certain break in connection with the beginning of the full-scale armed aggression of the Russian Federation, construction resumed in most of the territory of Ukraine. After all, the demand for real estate objects is growing in the rear regions. During the period of martial law, until mid-June alone, DIAM processed more than 10,000 requests from customers. Among them are more than 5,500 declarations about the object's readiness for operation (including amnesty) and more than 200 certificates of acceptance into operation.

Importantly! By its resolution № 722 of June 24, 2022, which entered into force on July 12, the Cabinet of Ministers simplified the implementation of some permit and registration procedures in the construction sector during the period of martial law and during the 1st year from the moment of its termination (cancellation).

Provisions of Resolution № 722 regarding putting real estate into operation

• The first important provision: the terms of providing administrative services in the construction sector have been restored. We remind you that the provision of administrative services was suspended during the martial law by Cabinet Resolution № 165 of February 28, 2022.

From July 12 (from the date of entry into force of Resolution № 722), state bodies. of architectural and construction control/ architecture and urban planning must provide administrative services within the terms established by law. In particular, the period for consideration of applications for the issuance of a certificate of acceptance of the object into operation is ten working days.

• The second important provision: in the conditions of martial law and within 3 months from the moment of its end (cancellation), it is allowed to postpone works on the improvement of the territory and decoration of facades. But this does not apply to transport routes and pedestrian communications.

The customer should make a note about this in the declaration or act of readiness of the object for operation. It specifies the types of work that are postponed and the final date by which the work will be completed.

What else should be considered?

Construction customers should take into account that the declaration on readiness for operation of individual residential buildings and other real estate objects of SS1 has been approved in a new edition - corresponding changes have been made to the Order of the Ministry of Community and Territorial Development № 158 dated 07.03.2018. Since the subsistence minimum for able-bodied persons has increased since July 1, 2022, the fee for issuing a certificate of acceptance into operation of a completed facility has increased. The actual cost is:

• 11,960 hryvnias for SS2 facilities;
• 13,520 hryvnias for SS3.
