Certificate of injury circumstances

Reading time: 4 min.

A certificate of the circumstances of injury or trauma is a document that contains information about the circumstances in which a serviceman or woman was injured, maimed or wounded. This document is more commonly known as a "Form 5" among military personnel. If you want to learn more about this topic or get support in other military law inquiries, you can contact the lawyers of Prikhodko & Partners Law Firm. This area of law is the focus of our practice. Therefore, we know how to help our clients efficiently and effectively.

What is a certificate of injury circumstances for?

This document helps servicemen establish a causal link between the circumstances of the injury and the defense of the homeland. This certificate is required when undergoing the military medical commission and the medical examination commission. It has a direct impact on the amount of one-time financial assistance paid if a soldier is diagnosed with a disability or partial disability.

Therefore, the certificate must contain the details required by the current legislation. Namely, the document must contain the following:

  • The circumstances under which the serviceman was injured. In particular, it should indicate the combat missions he or she was performing when he or she was wounded (contusion, injury or trauma).
  • Whether the soldier was under the influence of alcohol or drugs.
  • Whether the injury is related to the commission of an administrative or criminal offense.

To summarize, the document should make it clear that the injury was the result of performing combat missions related to the defense of the homeland.

Who is authorized to issue a certificate of injury?

A certificate of injury is issued by the head of the military unit's medical service. The document is signed by the commander of the military unit on the basis of the commander's order, which states that the serviceman was injured.

The information contained in the Form 5 certificate is extremely important. It is this factor that determines whether the serviceman will receive the proper amount of payment for his injury in the future.

Speaking generally about our services, the following areas are worth noting:

  • Counseling. When there is a huge amount of false information on the Internet, it is a consultation with a lawyer that becomes an opportunity for the client to get reliable answers and not spend a lot of time and effort on their own search.
  • Legal support. If you need to represent your interests in interactions with government agencies or specific officials, we will do so. We can also speed up the process of obtaining the necessary documents by sending a lawyer's request for their issuance.
  • Representation in court. If other legal instruments have proved ineffective, we go to court, because we are used to not stopping halfway and working for a predictable positive result.
