CASE: HOW TO SUE MONEY FROM AN INSURANCE COMPANY.

On August 14 and November 8, 2017 in the Shevchenkivskyi District Court of Kyiv a court session was held with the participation of Anatoly Perepelchenko, a lawyer of the law firm Prikhodko and Partners, on claims of our clients to one of the largest insurance companies in the field of life and health insurance for individuals.

The essence of the dispute was the failure of the insurance company to buy out the repurchase amount under the life and health insurance contract after transferring it to paid-for status.

The lawyers of our company took all measures to properly inform the Insurer about the need to pay the ransom amount to the Insured, however, there was no reply to all written requests.

We have prepared and submitted to the court applications for the total amount of claims to the insurance company in the amount of more than 300 000.00 hryvnia.

In the court session, Anatoly proved the legality and motivation of claims to the insurance company, substantiated the plaintiffs' position. Based on the results of the examination of the statements of claim in the court session, the court decided to collect for the benefit of our clients the redemption amounts, court costs, as well as the costs of legal assistance in full.

After receiving the original decision of the court and the writ of execution, we prepared and forwarded to the Department of State Executive Service an application for acceptance of the writ of execution for execution.

Also, at the request of our lawyers, the state agent seized all the debtor's property to ensure the real execution of the decision.

Now there is a clear control over the actions of the State Executive Service to execute an application for acceptance of the writ of execution for execution.
