CAN THEY BE MOBILIZED IF THEY HAVE NOT SERVED IN THE ARMY?

Reading time: 3 min.

Despite the fact that protecting the independence and territorial integrity of the Motherland is an honorable matter, it is important that the rights of citizens are respected in these matters. In practice, we often see the opposite, and the experience of the law firm "Prikhodko&Partners" in accompanying client requests related to military law shows that the human factor and the excess of official powers by military commissariat officials often do their job. Therefore, the client has to additionally defend those rights provided for by the current legal acts.

Are those who have not completed military service subject to mobilization?

Yes, the answer to this question is affirmative. All men between the ages of 18 and 60 are subject to mobilization, with the exception of situations expressly provided for by law. Persons who have not completed their military service are not included in these exceptions. Such persons make up the so-called public reserve - people who can be recruited into the Armed Forces, as well as other military formations, since they do not have age and health restrictions.

This means that such citizens are subject to mobilization. However, it is important to understand that they do not have the right to immediately send them to the front. More on that later.

How is the preparation?

Citizens who have not previously completed military service must be sent to the training centers of the Armed Forces of Ukraine. The task of these centers is to provide them with proper and comprehensive training. Only after that should the shipment to the military units take place.

The martial law in Ukraine imposed its limitations on the terms of training provided for in training centers for non-commissioned officers and privates. Preparation should last from 7 to 20 days. The exact number of days depends on the specific specialty. It is also stipulated in the current legal regulations that training should take place without reducing the quality of education. Therefore, it is strictly forbidden to send such a mobilized person to the front before he has acquired the skills of proper training and weapon handling.

How does it happen in practice?

If we move away from what the legal norms talk about and immerse ourselves in the real practical context, the situation is often sadder, and the mobilized are faced with various abuses by military commissariat officials in relation to themselves. Of course, this is far from all cases, but the general trend and practice of lawyers indicate complaints about numerous abuses. Therefore, in order to oppose them and defend your right to proper training, you should use legal assistance.
