Can representatives of territorial picking centers check documents?

Reading time: 3 min.

Given the state of war and general mobilization, document checks of citizens are quite common. However, in this regard, it is worth knowing some important aspects that relate to the order of this procedure. People often ask whether representatives of the military commissariat can verify documents. Let's understand this issue.

Do the military have the right to check documents?

Despite the fact that some phenomena seem familiar and natural, and many people do not know the details of the norms of the current legislation, it is important to understand the limits of competence of each specific state body. Verification of documents of citizens belongs to the powers of the National Police of Ukraine.

The military has no right to check documents or detain someone. If the military has any suspicions about a certain person and his actions, they must call the police and, with their participation, get an explanation from the person or check documents. TCK representatives cannot independently verify documents either.

How should police representatives check documents?

When police officers perform document checks, they too must conduct such activities within the framework of the law and explain their actions.

Despite the fact that representatives of recruitment and social support centers do not have the right to check documents on the streets, sometimes similar situations take place. Therefore, in such a case, it is worth asking the military to, in accordance with the norms of the current legislation, call the police and carry out such actions in their presence.

At one time, the topic of document verification raised many questions from people who encountered it. Therefore, the Ministry of Justice of Ukraine even gave an official explanation that representatives of the Territorial Centers of Recruitment and Social Support cannot check documents. At the same time, such interest often concerns another important topic - service of summonses. Indeed, in practice, the verification of documents may precede the subsequent delivery of a summons.

It is legal to serve summonses on the street during martial law. However, it must be accompanied by a police representative. Otherwise, Territorial Centers of Recruitment and Social Support representatives cannot demand his documents from a citizen.
