Can father and son be mobilized?

During the general mobilization throughout the territory of Ukraine, a rather urgent question is whether a father and a son from the same family can be mobilized at the same time. Since many people believe that they can mobilize only one able-bodied man from the family. However, such judgments are quite wrong.

It should be noted that the current legislation of Ukraine does not prohibit the mobilization of able-bodied men from one family. Accordingly, there is no legal ban on the simultaneous mobilization of father and son. Therefore, if the father and son/sons are fit for military service and have reached the mobilization age, they can be mobilized even at the same time. However, it should be understood that there are exceptions for certain categories of persons and then such mobilization may not take place.

First of all, in families in which there is, for example, a woman with a disability, father and son cannot be mobilized. Since someone is alone, in accordance with Article 23 of the Law of Ukraine "On Mobilization and Mobilization Training", he must take care of her and will have the right to postpone mobilization. The legislation does not stipulate who exactly will be entitled to such a postponement. Accordingly, father and son must personally decide among themselves who will be mobilized.

Also, for example, a father who has three dependent children under the age of 18 and an adult son cannot be mobilized together with an adult son. Because according to Article 23 of the Law of Ukraine "On Mobilization and Mobilization Training" he will have the right to postpone mobilization.

Accordingly, it is necessary to take into account the legal grounds of the father and son for obtaining a postponement from mobilization, accordingly, in such a case, the mobilization of the father and son cannot be carried out. However, if there are no legislative grounds for the postponement, then there are no legislative restrictions on the mobilization of the son and father.

It is worth noting that there are false opinions that it is not possible to mobilize a father and a son, due to the fact that one of the able-bodied men in the family should remain as the breadwinner. To date, there are no regulatory and legal acts that would provide for such a ban on mobilization.

Accordingly, today, there is a legal possibility to mobilize father and son at the same time. There are no laws that could cancel or prohibit such mobilization. It should be understood that the only reason for not mobilizing the father and son is that one of them has grounds for postponement of mobilization in accordance with Article 23 of the Law of Ukraine "On Mobilization and Mobilization Training".
