CALCULATION OF MILITARY PENSION. INCREASE FROM 10,000 TO 20,000 UAH

Volodymyr Leonidovych turned to JBC "Prikhodko&Partners" for help in recalculating the military pension. The pensioner was released from military service from the structures of the Ministry of Defense of Ukraine.

Until 2018, the Claimant was awarded a pension based on the following components of financial support for pension calculation:

• official salary;
• salary for a military rank;
• seniority allowance;
• additional types of financial support.

In 2018, the main administration of the Pension Fund of Ukraine in the Ternopil region recalculated the client's pension on the basis of the Certificate on the amount of monetary support for the recalculation of pensions as of 03/01/2018, in accordance with the Resolution of the CMU of 02/21/2018 № 103 "On recalculation of pensions to persons who are dismissed from military service, and some other categories of persons" and did not take into account additional types of financial support when calculating the pension.

At the Petitioner's request, the Ternopil OTCC and JV prepared a certificate on the amount of financial support as of 03/05/2019 for a similar position (on the day of dismissal) held by Volodymyr Leonidovych, indicating monthly additional types of financial support.

However, the Main Directorate of the Pension Fund of Ukraine in the Ternopil region refused to recalculate the pension on the basis of the certificate issued by the Ternopil OTCC and JV on the amount of financial support, taking into account additional types of financial support.

On July 13, 2022, the Ternopil District Administrative Court, in case № 500/2428/22, based on the above-mentioned claim, made a decision to satisfy the claim of Volodymyr Leonidovych, by which it decided:

- to oblige the Main Department of the Pension Fund of Ukraine in the Ternopil Region to recalculate and pay the pension to Volodymyr Leonidovych on the basis of the certificate of the Ternopil Regional Territorial Center for Staffing and Social Support dated February 24, 2022 № 11/1/1150, taking into account previously paid amounts.

In compliance with the decision of the Ternopil District Administrative Court in case № 500/2428/22 dated 07/13/2022, the client's pension was recalculated. As a result of the recalculation from 01.09.2022, the amount of the pension amounted to UAH 19,344.20. The debt as of January 1, 2018 is UAH 360,399.02.

This debt is recorded in the Pension Fund of Ukraine. In accordance with Article 8 of the Law of Ukraine "On pension provision for persons discharged from military service and certain other persons", the payment of pensions, including additional pensions, supplements, allowances and increases to them, compensatory payments, established by law, to servicemen discharged from service, persons entitled to a pension under this Law and their family members are provided at the expense of the State Budget of Ukraine.
