Article 305 of the Criminal Code of Ukraine – Smuggling (illegal movement) of narcotic drugs, psychotropic substances, their analogues or precursors or falsified medicinal products

Article 305 of the Criminal Code of Ukraine (CCU) concerns the illegal movement of narcotic drugs, psychotropic substances, their analogues or precursors across the state border of Ukraine. This article is one of the key ones in the fight against international drug trafficking.

1. Smuggling of narcotic drugs, psychotropic substances, their analogues or precursors —
   is punishable by imprisonment for a term of 5 to 8 years with confiscation of contraband.
2. The same actions committed repeatedly or by prior conspiracy by a group of persons —
   are punishable by imprisonment for a term of 8 to 10 years with confiscation of contraband and with confiscation of property.
3. Actions committed by an organized group or if they concern especially dangerous narcotic drugs or psychotropic substances —
   are punishable by imprisonment for a term of 10 to 12 years with confiscation of property.

The elements of the crime are:

• Objective side, i.e. the crime consists of: the movement of drugs, psychotropic substances, their analogues or precursors across the state border of Ukraine; the methods of movement may be concealed (for example, the use of hiding places in vehicles or cargo). The movement may be carried out both from Ukraine abroad and from abroad to Ukraine.
• Subjective side: the crime is committed intentionally. The person is aware that he is transporting drugs or other prohibited substances across the state border, and has the aim of their further sale or use.
• The subject of the crime is any individual who has reached the age of 16.
• The object of the crime is public safety and health of the population; the economic interests of the state.

Aggravating circumstances are:

1. Committing a crime repeatedly. Repetition indicates the systematic nature of the person's illegal activity.
2. Prior conspiracy of a group of persons. Planning and committing a crime jointly by several persons indicates increased public danger.
3. Committing by an organized group. In such cases, the crime is part of the activities of a drug cartel or other organized criminal structure.
4. Moving especially dangerous narcotics. Such substances have a strong effect on the body, which increases the risks to public health.

As for judicial practice, the main evidence is: 1) detection of prohibited substances (substances are found during customs inspection, operational search measures or inspections of vehicles); 2) examination to confirm that the seized substances are narcotics or their analogues, a chemical examination is performed; 3) confession or testimony of other persons, for example, participation in a criminal group can be confirmed by the testimony of accomplices.

Typical situations include:

• Using international flights to transport drugs in luggage.
• Attempts to smuggle drugs across the border using postal parcels.
• Involving “drug couriers” who transport drugs in their bodies (“implanted packages”).

Combating drug smuggling

1. Strengthening customs control.
   Using modern technologies, including scanners and sniffer dogs, to detect drug caches.
2. International cooperation.
   Effective combat is possible only in coordination with other countries, since drug trafficking is a global problem.
3. Prevention of citizen involvement.
   Conducting information campaigns to prevent the use of Ukrainians as “couriers”.
4. Legislative initiatives.

Constantly updating legislation in accordance with international standards.

Article 305 is key in ensuring national and international security. Drug smuggling harms society, undermines the health of citizens, and finances organized crime and terrorism.

Increasing responsibility for such crimes demonstrates the seriousness of the state's intentions to combat drug trafficking. At the same time, success in the fight depends not only on the severity of punishment, but also on the effectiveness of law enforcement agencies and international cooperation.

The fight against drug smuggling is international in nature, since drug trafficking often involves several countries.

International agreements and obligations of Ukraine

1. Single Convention on Narcotic Drugs of 1961
   This document regulates the fight against illicit drug trafficking on an international scale. Ukraine is a party to this convention.
2. UN Convention against Transnational Organized Crime of 2000
   It establishes the principles of cooperation between states to counter organized criminal groups involved in drug smuggling.
3. Interpol and Europol
   Ukraine actively cooperates with these organizations to track and disrupt the activities of international criminal groups.

Examples of joint operations: monitoring sea and air transport that can be used to transport drugs and identifying and dismantling drug manufacturing laboratories operating in different countries.
