APPLICATION TO THE MILITARY COMMITTEE FOR POSTPONEMENT
Postponement of military service due to mobilization under martial law is a common practice that is used when a person has objective circumstances that do not allow him to perform military service at the moment. There are quite a few such grounds, and a qualified lawyer will help you sort them out and find out if your situation falls under any of them.
Grounds for postponement
People who:
- have armor from state authorities or local self-government;
- recognized as persons with disabilities in accordance with the procedure established by the VLK;
- support 3 or more children under the age of 18;
- raise a child with a disability up to the age of 18;
- raise a child with severe perinatal diseases of the nervous system, insulin-dependent diabetes and a number of other diseases, an exhaustive
- list of which is established by current legal norms;
- support an adult child with II or I group disability;
- are adoptive parents, custodians or guardians of a child under the age of 18 and support him;
- engaged in constant care of a person for whom there is a valid medical opinion regarding his inability to take care of himself;
- have a minor child and a spouse who is in military service.
In addition, people's deputies of Ukraine, employees of military administration bodies, military units, enterprises subordinated to the Ministry of Defense and a number of law enforcement agencies have the right to a postponement.
The procedure for obtaining a postponement
Getting a deferment from military service takes place in the following order:
- you go to the recruitment and social support center (military commissariat) with an application, where you must indicate the reason for which, in accordance with Article 23 of the Law "On Mobilization Training and Mobilization", you have a deferment from military service;
- attach documents to the application that testify to the facts stated in it regarding the existence of grounds for postponement;
- you control that the application is registered in the journal where the incoming correspondence of the military commissariat is recorded.
This completes your actions and begins the review period of the submitted application. Next, you will receive an extract from the protocol book, which will certify the postponement.
Documents confirming the right to postponement
The exact list of documents that must be submitted with the application depends on the reason for which you want to get a deferment. For example, these can be medical certificates, conclusions of the Ministry of Health and Welfare, documents confirming the health status of relatives and your care for them, as well as birth certificates of minor children.
Advantages of professional help
Unfortunately, even if there are reasons for postponement, people often become victims of abuse and bureaucracy on the part of the leadership of military commissars, whose powers under martial law are quite broad. A good lawyer helps to correctly draw up an application, clearly confirm the reasons for the postponement with reference to all legal grounds and accompanying documents that confirm them. In addition, the lawyer advises and helps to resolve issues in case of unforeseen complications or excess of powers by officials. Therefore, interaction with a good lawyer is a guarantee of a positive result and your opportunity to defend your rights.
