APPEALS ABOUT THE CONCLUSION OF THE MILITARY-MEDICAL COMMISSION OF THE ARMED FORCES OF UKRAINE

The Military Medical Commission of the Armed Forces of Ukraine aims to determine the fitness of health for conscription, servicemen, conscripts. In addition, the purpose of this commission is to establish the circumstances that caused a particular injury, disease, as well as injuries, contusions, etc.…

At the same time, the commission determines the need and prescribes measures to rehabilitate servicemen after injuries, contusions, injuries.

Measures carried out by the military medical commission of the Armed Forces of Ukraine:

• Medical examination of conscripts;
• Medical examination of conscripts;
• Medical examination of servicemen;
• Medical examination of reserve officers called up for military service;
• Medical examination of persons concluding a contract on military service with the Armed Forces of Ukraine;
• Medical examination of entrants to higher military educational institutions;
• Medical examination of former servicemen;
• Medical examination of employees of the Armed Forces of Ukraine;
• Determining the level of suitability for military service, study in relevant higher education institutions;
• Establishing a cause-and-effect relationship between diseases and other health conditions.

As a result of conducting one of the above-mentioned measures, the Military Medical Commission shall issue a resolution stating the decision taken.

Such a decision may be in the form of a decision on the presence of the disease, as well as in the format of a certificate of the existence of certain facts that determine the causal relationship to disease, injury, contusion, etc.…

These regulations are binding.

Procedure for appealing decisions of the military medical commission of the Armed Forces of Ukraine

The Order of the Ministry of Defense of Ukraine of August 14, 2008 № 402 determines the procedure for appealing the decisions of the military medical commissions of the Armed Forces of Ukraine. This order determines the possibility of appealing the decisions of military medical commissions of districts or cities to regional commissions. And resolutions of any military medical commissions to the central medical commissions.

At the same time, the decision of the military medical commission may be appealed in court according to the rules of administrative procedure.

If the procedure for appealing the decision of the commission is planned to the highest body of the military medical commission, it is necessary to prepare a corresponding application for review of such decision. Such a statement must be accompanied by all the necessary documents issued by the military medical commission.

The application itself must contain a clear justification of the grounds relied on by the applicant, the reasons that are prerequisites for reviewing the decision, these may be, for example, preliminary conclusions of commissions, certain documents on the basis of which the person was declared unfit for military service.

Thus, it is possible to appeal the decision of the military medical commission, but there must be clear grounds for this, such as health problems.
