ABOUT THE TERM OF THE FOREIGNER’S STAY IN UKRAINE
Term of stay of a foreigner in Ukraine is a term established by the legislation of Ukraine, which a foreigner may spend legally (legally) on the territory of Ukraine. However, it has only a certain period of time, so it tends to end, which gives rise to various legal consequences.
For visa countries, this period is limited by the validity of the visa. For visa-free countries with Ukraine, foreigners can stay in Ukraine under the 90/180 rule.
That is, this rule should be considered as follows: for the last 180 calendar days, a foreigner can stay in Ukraine for a maximum of 90 days.
If you exceed this norm for at least one day - you will need to pay a fine and leave Ukraine immediately. Therefore, it is extremely important to monitor your stay.
But if you are a frequent traveler and are already confused in your stamps about "departure" and "entry" to Ukraine in a foreign passport - you can count the period of stay on the official website of the State Migration Service (there is a migration calculator function).
You can use it at the link: https://dmsu.gov.ua/services/migcalculator.html
In the migration calculator you need to enter information about:
- the date of the inspection (the day on which the inspection is carried out (this is the date of the planned or actual departure from the country);
- the calculated date of the beginning of the control period;
- dates of entries and departures.
Then you need to click the "calculate" button, after which a number will appear in the "Number of days" column, which will indicate the number of days of your stay in Ukraine. If you have had several trips in the last 180 days, you need to click the "Add trip" button and fill in the above information for each of them.
It is important to monitor the length of stay of foreigners who wish to issue a Temporary Residence Permit in Ukraine. This is due to the fact that the submission of documents must be made 15 working days before the end of the stay. In addition, violation of such a term entails administrative liability.
If the terms of stay on the territory of Ukraine are exceeded during the quarantine period, such persons shall not be held liable for this offense. This is stated on the official portal of the Cabinet of Ministers of Ukraine.
It is necessary to take into account:
- working days are not calendar days. That is, working days are days from Monday to Friday;
- always include public holidays in this list.
In addition, the period of stay in Ukraine can be extended. The reason for this is:
- registration of the Permit for immigration to Ukraine;
- registration of citizenship of Ukraine;
- impossibility to leave (must be confirmed by a relevant document);
- other cases (treatment, pregnancy, care of a sick family member, registration of inheritance, etc.) (also confirmed).
Do not forget that in case of extension of your stay you cannot leave Ukraine. Otherwise, such extension will be canceled.
