The issue of making a will in our country is always special. This is explained by the fact that citizens usually do not think about the possible bad consequences that may happen to them in life, and make a will only when they are already old.

However, today there is a war in Ukraine, in which we are fighting for the right to remain an independent state.

And therefore, during hostilities, no one guarantees that everything will be fine with a citizen. What is the relevance of the chosen topic.

In this informative article, we will consider the peculiarities of making a will for a minor child under Ukrainian law.

What does a will consist of?

Will - is a written legal document in which (in addition to the text of the will itself) the place and time of its drafting, the term of validity of the will and the place of birth of the testator are indicated.

In addition, the text of the will itself should not contain spelling and punctuation errors that lead to its illegibility and lack of clarity in understanding the content.

This is necessary in order to avoid any disputes between the heirs at the time of opening the inheritance.

It should also be noted that if the will is written correctly, the notary checks it for the content of instructions that should not contradict the law, and if he does not find them, he makes an official notarization.

Importantly! If the heirs are minors, minors, incapacitated persons or persons whose civil capacity is limited, on the issuance of a certificate to the executor of the willthe notary notifies the relevant guardianship and custody authorities.

What should be remembered when drawing up a will for a minor child?

  • she has the right to a mandatory share in the inheritance (Article 1241 of the Civil Code), and therefore other heirs do not have the right to deprive a person of her legal share in the inherited property;
  • a minor can independently submit an application for acceptance of inheritance, without the mandatory consent of his parents.An application for acceptance of inheritance on behalf of a minor, incapacitated person is submitted by his parents (adoptive parents), guardian;
  • until she reaches the age of majority, her parents/guardians/adoptive parents, with her consent, will perform any transactions regarding the inherited property;
  • if the testator wants the child to dispose of the property independently, then in this case it will be necessary for him to obtain full civil legal capacity;
  • the presence of a will does not deprive a person of the right of inheritance by law.

Importantly! The will can be made to any person whom the testator wishes to specify, while he can be a minor (up to 14 years old), a minor (from 14 to 18 years old), or an unborn child, but conceived during the life of the testator.
