What documents are required for divorce in Ukraine?

List of documents for dissolution of marriage usually depend on the way in which the citizens decided to divorce.

Yes, if the divorce takes place voluntarily through the bodies of the DRATSS, the following documents are required, namely:

  • copies of passports of citizens of Ukraine;
  • RNOCPP;
  • the original of the marriage certificate;
  • a joint written statement of divorce, in which it is mandatory to state that the citizens independently decided to divorce without coercion and do not have any property claims against the parties;
  • the decision of the judicial authorities to recognize the other member of the spouse as missing or incapacitated (it must be submitted only when the divorce takes place at the request of one of the spouses).

If the married couple decided to dissolve the marriage with the help of judicial authorities, the following documents must be submitted, namely:

  • a statement of claim (it must be submitted in 2 copies, because according to the current legislation, the other party to the claim proceedings must familiarize itself with the claim requirements of the person who submitted the statement);
  • copies of passports of citizens of Ukraine;
  • RNOCPP;
  • the original of the marriage certificate;
  • copies of children's birth certificates (if the spouses have them);
  • a copy of the receipt from a financial institution (bank) for the payment of the court fee (however, if the person is exempt from paying the court fee, documents confirming this fact must be submitted).

Is it possible to divorce in Ukraine remotely?

In Ukraine, during martial law, it is only possible to file an application for divorce online.

For this, the following algorithm of actions should be followed, namely:

  • go to the "Electronic Court" state website using the search engine;
  • register on the site with a mandatory e-mail address and each time use your own electronic digital signature to confirm your identity;
  • after registering on the website, fill out a claim;
  • attach to the application all the necessary documents and evidence that you consider necessary in PDF format;
  • pay the court fee online.

After a citizen files a lawsuit through the "Electronic Court", using a personal account, it is possible to track the progress of the case, review any adopted resolutions or decisions, dates of court hearings, etc.

At the same time, it is not necessary to constantly visit the site and review the availability of updated information on the case, because all data will be duplicated to the e-mail address of the person who was specified during his registration.

Pay attention! Although it is possible to submit a statement of claim and documents remotely, as a rule, consideration of court hearings always takes place in an in-person format.

Is it possible to divorce online using "Dia"?

As of 2024, Ukraine only provides for the possibility of registering a marriage between citizens using the Diya software. That is why it is currently impossible to file a divorce through this program.

However, after registration of the dissolution of marriage in the DRATSS or judicial authorities in "Diya" may:

  • get an official divorce document;
  • order to receive a paper divorce document at the selected Ukrposhta branch.
