The following liability is provided for intentional murder, specified in the provisions of the Criminal Code:

• Article 115 – deliberate murder with qualifying features.
• Article 116-118 – murder committed in a state of strong emotional shock, excess of self-defense, committed by a mother in relation to a newborn child.

In order to classify a criminal act as intentional, pre-trial investigation bodies must establish the composition of the crime, paying special attention to the subjective side. That is, the attitude of the accused or suspect to the consequences of his actions is analyzed. All actions must be intentional, that is, a person must consciously wish death to another person. It is a completely different matter when death occurred due to carelessness.

So, for example, for committing intentional murder, the punishment is from 7 to 15 years of imprisonment. If there are qualifying signs, the punishment is more severe - from 10 to 15 years. It is also possible to make a decision on life imprisonment (part two of Article 115 of the Criminal Code of Ukraine).
