According to the current Ukrainian legislation, putting the real estate object into operation is a mandatory procedure. However, not always the owners of a house, apartment or other real estate object pay due attention to this procedure. That is why the existence of self-builds remains an acute issue in Ukraine. The self-construction category includes various types of real estate. These can be houses (cottage, residential), structures, buildings, the construction of which was not accompanied by the issuance of the relevant permit documentation.

Legalization of independent construction is a legal process related to state registration of ownership. If this procedure is ignored, the responsibility defined by the current legislation follows, namely:

  • Warning.

We are talking about the prescription of DIAM (State Inspection of Architecture and Urban Planning).

  • Fines.
  • Forced demolition of the real estate object.

In addition, without acceptance into operation, the owner of the real estate cannot become its full manager, namely: he will not have the right to sell, exchange, lease, etc. Also, the real estate object cannot be legally connected to such engineering networks as gas, water, heat, electricity. The supply of energy carriers is possible only in the presence of relevant contracts.

Documents on the registration of ownership of the real estate object are considered within 5 working days. As a result, the real estate owner receives an extract from the state register of property rights to real estate.

An important issue also concerns the construction amnesty. In 2018, a construction amnesty was introduced for houses built between 1992 and 2015. That is, it is still possible to register these houses according to the appropriate procedure.

Stages of self-construction commissioning

Current Ukrainian legislation regulates the implementation of all construction processes only with the accompaniment of a large package of documents. Carrying out work on various real estate objects is prohibited from legal registration.

To put self-build into operation, you need to take just a few steps:

  1. Passing technical inventory.
  2. Registration of the Declaration on putting the object into operation in the State Agency for Economic and Social Affairs.
