MEASURES TO ATTRACT CITIZENS OF THE REPUBLIC OF BELARUS TO UKRAINE

 On December 23, 2020, the Government of Ukraine adopted a resolution aimed at the implementation of Article 1 of the Decree of the President of Ukraine “On some measures to attract entrepreneurs, highly qualified specialists who are citizens of the Republic of Belarus”.

 This regulatory legal act simplifies the procedure and procedure for obtaining a residence permit for citizens of the Republic of Belarus who, according to this Decree, are entrepreneurs, highly qualified specialists, in particular, specialists in the field of information technology and innovation, as well as members of their families.

 According to current requirements, citizens. Belarus, who came to Ukraine and applied to the migration service, observing all the requirements of the law, with an appropriate application for granting them an immigration permit, as highly qualified specialists, the urgent need for which is tangible for the Ukrainian economy, have the right to simultaneously apply for a residence permit for the same basis. A temporary residence permit must be issued for the entire period of consideration of an application on the issue of granting a permit for immigration to Ukraine. Referring to the Law of Ukraine "On Immigration" - up to 12 months. The presence of a residence permit will make it possible to cross the border without obstacles during the validity of the most temporary residence permit.

 Also, this Decree raises the question of the need to extend the period of stay in Ukraine for citizens of the Republic of Belarus up to 180 days for 365 days, who are entrepreneurs, highly qualified specialists, including in the field of innovative technologies and innovations, whose immigration is in the interests of Ukraine. That is, instead of 90 days for 180 days.

 If we consider this Decree of the President of Ukraine, then we can say that this act creates more favorable conditions for Belarusians to stay on the territory of Ukraine, as well as conditions for legalization (recognition of documents necessary for the implementation of labor activity in Ukraine, which were issued in the Republic of Belarus), the right to employment (shortening the time required for obtaining a work permit to 5 days) and doing business (including improving the procedure for registering an individual entrepreneur). One of the main issues that are raised in the Decree is the development of a pilot project of legal regulations, according to which it will be possible to obtain a residence permit in 3 days, specifically for citizens of Belarus who are classified according to the Decree.

 But also, the presence of a Decree for Belarusians and a resolution that approves the order can generate a lot of discontent on the part of other states and their citizens. Referring to political circumstances, social and economic instability, wars, using the example of citizens of countries such as Iran, Egypt, Afghanistan and other countries, whose foreign citizens almost every day try to cross the border of Ukraine, legalize here, but do not get such conditions for stay as Belarusians. For them, this question may become relevant.
