GAMING BUSINESS AGAIN “IN LAW”

 On August 11, 2020, the President of Ukraine Volodymyr Zelensky signed the Law “On State Regulation of Activities Concerning the Organization and Conduct of Gambling” (hereinafter - the Law), which provides for the legalization and state regulation of gambling in Ukraine. It is worth noting that the gambling business in Ukraine was completely banned in 2009.

 The newly adopted Law introduces state supervision, control and regulation of gambling held on the territory of Ukraine and provides for:

an exhaustive list of activities in the field of gambling that are subject to licensing and have the right to exist in Ukraine, all types of gambling that are not provided by law in Ukraine are prohibited;

licensing of each type of activity in the field of gambling with the amount of the license fee, which is formed from the amount of the minimum wage and depends on the location of the casino, the type of gambling that is licensed, etc .;

compliance of gaming equipment with international standards - by licensing each gaming equipment;

requirements for gambling organizers and officials of such organizers, including the financial condition to ensure their financial stability and guarantee the payment of winnings;

creation of a state regulator in the field of gambling - the Commission for the Development and Regulation of Gambling, whose powers include licensing of gambling organizers, licensing of gaming equipment, issuing permits for premises where "gambling zones" are located, maintaining the necessary registers and control in compliance with the license conditions;

online monitoring system of the organizer, players, to ensure state control over gambling, compliance with licensing conditions and conditions for receiving visitors;

financial, administrative and criminal liability for violations of gambling legislation.

 In addition to the provisions on criminal liability, online monitoring and equipment certification systems, the entry into force of which is postponed for a period of 1 month to 2 years, the Law enters into force after its official publication.

 Also, on December 21, 2020, the Cabinet of Ministers of Ukraine adopted a resolution "On approval of licensing conditions in the field of organization and conduct of gambling" № 1341 (hereinafter - the Resolution). The resolution, in particular, approved:

• licensing conditions for conducting activities in the field of organizing and conducting gambling in casino gambling establishments;
• license conditions for conducting activities in the field of organization and conduct of gambling in the halls of slot machines;
• licensing conditions for carrying out activities in the field of organization and conduct of bookmaking activities in bookmakers and on the Internet;
• licensing conditions for conducting activities in the field of organization and conduct of casino gambling on the Internet;
• licensing conditions for conducting activities in the field of organizing and conducting gambling poker on the Internet.
