Appeal – it is a legal procedure that allows an appeal against a decision of a court of first instance to a higher court. In other words, it is an opportunity to review the case once again and check whether the court’s decision was made correctly, taking into account all legal norms.
The court’s decision on divorce may be challenged in the appeal procedure if one of the parties believes that judicial errors were made during the proceedings.
The grounds for appeal may be different:
- Violation of procedural norms: non-observance of review deadlines, refusal to accept certain evidence, incorrect application of procedural legislation, etc.
- Violation of material norms: incorrect application of the norms of the Family Code, incorrect determination of the grounds for divorce, errors in the distribution of property or the appointment of alimony.
- The impartiality of the court decision: the court’s conclusion does not correspond to the actual circumstances of the case, important evidence is not taken into account.
Both parties to the marriage process, as well as other persons whose rights and interests were violated by the court’s decision, have the right to file an appeal.
As a rule, an appeal can be filed within a certain period after the parties to the case have received a copy of the court decision. The exact time limit is set by law and may vary depending on the type of case and jurisdiction.
An appeal is submitted in the form of a written statement – an appeal. In the complaint, it is necessary to clearly indicate which court decisions are contested, which violations of the law were committed and which evidence confirms these violations.
After the appeal is filed, the case is referred to the Court of Appeal. The appellate court verifies the legality and reasonableness of the decision of the court of first instance, examines the case materials and may hear the parties’ explanations.
The appeal must include the following information:
- Name of the court to which the complaint is filed.
- Surname, first name and patronymic of the appellant.
- Name of the court that made the appealed decision.
- Civil case number.
- Reference to a court decision that is subject to appeal.
- Argumentation of disagreement with the court’s decision, i.e. indicating, in the opinion of the appellant, mistakes made.
- Documents that confirm the validity of the appeal.
- Request for full or partial annulment of the decision of the court of first instance.
