The procedure for obtaining permission to begin construction
The procedure and types of obtaining documents regulating construction permits are clearly outlined in the Law of Ukraine “On the Regulation of Urban Development Activities” and the Resolution of the Cabinet of Ministers of Ukraine “Some Issues of Preparatory and Construction Work” (as amended on April 13, 2011 No. 466).
Obtaining permits is a prerequisite for new construction, as well as redevelopment, reconstruction, restoration of a real estate property, which is accompanied by intervention in the load-bearing structures or a change in the geographical configuration of the building.
Classes of responsibility (consequences): features
The class of liability is a parameter that determines the significance of the decommissioning of a property in relation to human safety, social and material losses. This means that government authorities in the field of construction and architecture put forward certain requirements within the framework of which it is necessary to carry out the design and construction of real estate. The main goal is to obtain a high-quality result in accordance with current standards.
It is the class of consequences that will determine how complex the process of developing and approving the project will be. This is explained by the fact that the class of consequences completely regulates the number of stages associated with the design and scope of the project as a whole.
The class of consequences (CC1, CC2, CC3) depends on the following characteristics:
- There may be a danger to the health/life of people who will be directly or indirectly related to the property (located inside the property or in the adjacent territory).
- Risks of social or material damage.
- The level of the property in the state sense.
- The importance of the property in its historical context.
In most cases, the class of consequences is determined by the general designer or chief architect. They are the ones who calculate the class of consequences of each specific property. The resulting calculations are given in the explanatory note of the construction design documentation.
Let’s take a closer look at objects belonging to different classes of consequences:
- CC1.
This category includes: private single-family houses, mobile homes, residential buildings up to 4 floors, cafes, restaurants, cafes.
- CC2.
Residential buildings above 4 floors, offices, hotels, dormitories, clinics, gyms, catering and retail establishments.
- CC3.
Multifunctional and shopping and entertainment centers, hospitals, hospitals, educational institutions (schools, institutes, universities, etc.), infrastructure facilities, large industrial facilities, civil protection storage facilities, high-risk facilities.
