Case: Helped keep a client’s driver’s license after an accident

Customer request:
Client Artem, while leaving the parking lot of one of the capital’s housing complexes, was hit by another car that was moving toward him. Taking into account minor damages, which actually did not affect the operation of both cars – Artem offered to compensate the victim on the spot, but he refused and called the police.
Due to the fact that Artem was in a hurry, he drove away from the scene of the accident.
Later, representatives of the patrol police searched for Artem and drew up two reports against him – under Articles 124 (traffic accident) and 122-4 (leaving the scene of a road accident) of the Code of Ukraine on Administrative Offenses.
The lawyer of the “Prikhodko and Partners” law firm reviewed the case file on Artem’s administrative liability.
Having studied the protocol and explanations of the victim and the Client in detail, the lawyer agreed on a position with the Client regarding the admission of guilt in such a case without applying a sanction in the form of deprivation of the right to drive.
According to the Code of Ukraine on Administrative Offenses, the court at its own discretion decides which sanction to apply to the offender, based on the materials and circumstances of the case.
Therefore, the court was provided with written explanations of the case and other documents, in which it was stated that the Client admitted guilt in the committed offenses, but the urgency and need for the Client to leave the scene of the accident at that moment was proved.
Thanks to this, the court made a decision to bring the Client to administrative responsibility without applying a sanction in the form of deprivation of the right to drive a vehicle, but only with the application of a fine in the amount of 3,600 hryvnias.
Such a decision was the goal in this case.
