GROUNDS FOR A RESIDENCE PERMIT IN UKRAINE
As in any other country, in order to legally stay in it, it is necessary to obtain a document of the prescribed format. The first article of the Law of Ukraine "On the Legal Status of Foreigners and Stateless Persons" indicates that the only document that confirms the right of a foreigner to his legal stay in Ukraine, as well as his identity, is a permanent residence permit.
Who can get a residence permit in Ukraine?
- foreign citizens, i.e. citizens of other countries;
- persons who do not have any citizenship, i.e. stateless persons.
In accordance with the Law of Ukraine "On Immigration", the specified persons have come to Ukraine and wish to remain in the country for permanent residence.
If a person wishes to obtain a permanent residence permit in Ukraine, he must apply in person if he is over 16 years old, or his guardian or custodian can do this in case the person is incapacitated.
Where to apply?
In order to obtain a residence permit in Ukraine, it is necessary to apply to the territorial divisions of the State Migration Service of Ukraine (SMS) at the place of residence or stay with an application-questionnaire. Also, services for issuing a residence permit in Ukraine are provided by centers for the provision of administrative services (TsNAP).
Documents required for obtaining a residence permit
- First, a foreigner's application form for obtaining a passport must be filled out.
- Secondly, the original and a copy of the passport or other identity document of a foreigner must be submitted to the application form. The passport document must also be translated into Ukrainian and duly certified.
- Third, a copy of the immigration permit decision and a receipt for the payment of the administrative fee are provided.
The term of consideration of documents
The questionnaire application together with the submitted documents is considered within 15 days. After that, a residence permit in Ukraine is issued, which is valid for 10 years.
If a person's personal data has changed, for example, the surname after the conclusion or dissolution of marriage, then the passport can be exchanged at the migration service authorities within a month from the date of submission of the documents.
But there are also cases when a foreigner is refused a residence permit. The reasons for refusal are different. Of course, it is clear that it is not always possible for a foreigner to collect the necessary documents or fill out the application correctly. Therefore, in some cases, the help of a specialist is needed in the preparation of documents for submission to the Ministry of Internal Affairs and Communications to obtain a permit. Or even when it is necessary to appeal the decision of the local authorities to refuse to issue a permit without the help of a lawyer.
