Terms of return of the purchased goods to the seller

In accordance with the Law of Ukraine "On consumer protection" there are two situations of exchange or return of purchased goods:

In case of purchase of inadequate quality goods:
According to Art. 8 of this Law, when identifying material defects that arose due to the fault of the manufacturer of the goods, during the warranty period the consumer has the right to replace the goods or return the money.

An essential disadvantage, according to Clause 12 of Art. 1 of the Law of Ukraine "On the Protection of Consumer Rights" is considered a defect that makes impossible or inappropriate use of the product in accordance with its intended purpose, it arose from the fault of the manufacturer, after its elimination manifests itself again on reasons independent of the consumer and at the same time endowed with at least one of such signs:

a) he can not be eliminated at all;

b) it requires more than fourteen calendar days for its elimination;

c) he makes the goods essentially different from the one stipulated in the contract.

In case of necessity of checking the quality of goods, an examination may be carried out, in the course of which the consumer is found to be in violation of the warranty conditions of the goods. In accordance with Clause 4 of Art. 17 of the Law of Ukraine "On Protection of Consumer Rights" examination is organized within three days from the date of receipt of written consent from the consumer for the examination of products. If, as a result of the examination, it will be proved that the defects occurred after the goods were transferred to the consumer afterwards, the consumer's violation of the rules of operation, storage and transportation, the requirements of the consumer are not subject to satisfaction, and the consumer is obligated to reimburse the costs of conducting an examination.

The requirement of the consumer to replace the goods shall be immediately satisfied if it is available, and in the absence thereof - within two months from the date of submission of the application. If it is not possible to satisfy the demand within the established term, then the consumer is entitled to demand replacement of the goods with defects on another product of another brand (model) of appropriate quality with an appropriate re-calculation of the price or return of money. The consumer's claims about the return of money are subject to satisfaction within seven days. Calculation with the consumer in the event of an increase in the price of goods is made - based on the value of goods at the time of purchase.

Purchase of good quality goods, but if the goods for some reason did not approach the buyer.
According to Art. 9 of the Law of Ukraine "On consumer rights protection" the consumer has the right within 14 days to replace the good quality product with a similar one if the goods did not fit in the form, size, shape, color or can not be used for its intended purpose, but provided that the goods are not used and preserved its commercial appearance, consumer properties, seals, factory packaging, documents.

If at the moment of exchange the similar goods are not on sale, the consumer has the right to purchase any other goods, or to receive back the money in the amount of the value of the returned goods, or to change the goods to the same at the first receipt of the corresponding product in the sale. When money is returned, calculations with the consumer are made based on the value of the goods at the time of purchase. Money is returned within seven days.

The requirements of the consumer are considered only after specification of the surname of the customer and the order number, complete set of goods, factory packing, on which the bar code, the warranty coupon. Replacement of goods or return of money is possible only with the observance of all conditions and procedures.

You will be denied goods replacement or refund if:

a product that has no significant defects is not new, i.e. was in use;
more than 14 days have passed since the purchase of the goods
when checking the quality of the goods, signs of external interference (opening, attempt of repair) or other terms of guarantee service are found;
there is no document confirming the fact of purchase of the product, or a warranty card, a complete set of goods.
We also pay your attention that according to Clause 3 of Art. 4 of the Law of Ukraine "On Protection of Consumer Rights" the consumer is obliged:

1) before the beginning of the operation of the product, read carefully the operating rules set forth in the documentation provided by the store for the goods;

2) if necessary, obtain clarification of the terms and conditions of use of the product - ask the seller for clarification before using the product;

3) use the product according to its intended purpose and adhere to the conditions (requirements, norms, rules) established by the manufacturer of the product in the operational documentation;

4) in order to prevent negative consequences for the consumer in relation to the use of the product - to adhere to the safety procedures provided by the manufacturer in the product and the special rules provided for in the operational documentation, and in the absence of such rules in the documentation - to adhere to the usual understandable security methods established for such goods.
