PROTECTION OF FOREIGN CITIZENS IN UKRAINE

In accordance with the Law of Ukraine "On Refugees and Persons in Need of Additional or Temporary Protection" dated 08.07.2011 No. 3671-VI (hereinafter - the Law), Ukraine provides protection to foreign citizens and stateless persons, they are sought on its territory, by:

recognition as a refugee;

recognition as a person, needs additional protection;

recognition by persons in need of temporary protection

According to the provisions of the Law, a person who is not a citizen of Ukraine and who, due to justified fears of being persecuted on the grounds of race, religion, nationality, nationality (citizenship), membership of a particular social group or political convictions, is recognized as a refugee outside the country of his or her nationality and can not enjoy the protection of this country or does not want to use this protection because of such fears, or, without citizenship (citizenship) and is Limit edge on us constantly svoeho prezhneho accommodation, Can not or will not return to zhelaet nee Due ukazannыh opasenyy.

Persons in need of temporary protection are foreigners and stateless persons who are massively compelled to seek protection in Ukraine as a result of external aggression, foreign occupation, civil war, ethnic conflicts, natural or man-made disasters or other events that violate public order in a particular part or all over the country of origin.

In accordance with the provisions of the Law, a foreign citizen may apply for recognition as a refugee to the appropriate body of the migration service.

In accordance with the provisions of the Law, a foreign citizen or a stateless person applies an application for recognition as a refugee or a person, who needs additional protection, to the territorial body of the State Migration Service of Ukraine. Such an application is filed by an alien or stateless person or his legal representative personally at the place of temporary residence of the applicant. The basic form of granting protection to foreign citizens in Ukraine as a refugee or a person requires additional protection.

 A refugee or a person needs additional protection can not be expelled or compelled to return to a country where their life or freedom is threatened by race, religion, nationality, nationality (citizenship), belonging to a particular social group or political beliefs, and also with other reasons, are recognized as international treaties or international organizations to which Ukraine is party, such as those which can not be returned to the countries of origin.

A person with an intention to be recognized as a refugee in Ukraine or a person needs additional protection, crossed the state border of Ukraine in the manner prescribed by the legislation of Ukraine, must within five working days apply to the relevant territorial body of the migration service with a petition for recognition as a refugee or a person who needs additional protection.

The migration service authority, which has accepted the application of an alien or stateless person for recognition as a refugee or a person, needs additional protection, issues the applicant a certificate on application for protection in Ukraine and registers the applicant. Within fifteen working days from the date of registration of the application, the migration service agency conducts an interview with the applicant, reviews the information contained in the application and other documents, requires additional information and makes a decision on the execution of documents.
