OPERATION MIGRANT

From March 1 to May 31 of this year, targeted preventive measures are taken on the territory of Ukraine to supervise and control the implementation of legislation in the field of migration under the conditional name "Migrant".

The operation involves the State Migration Service, the State Border Guard Service, the National Police and the Security Service of Ukraine.

The preparatory stage lasted from March 1 to March 15, and the practical one lasts from March 16 to May 31.

The main purpose of the operation is to prevent and counteract illegal migration, as well as to verify the observance by the foreigners and stateless persons of the established rules of stay on the territory of Ukraine.

Last year, as a result of a similar operation, 3502 administrative offenses committed by foreigners and stateless persons were brought to administrative responsibility, in accordance with the competence of the State Border Guard Service of Ukraine, more than 3300 people, the amount of fines exceeded UAH 8.2 million.

As a result of the interviews, 1 679 foreigners, potential illegal migrants, refused to enter Ukraine. A decision was made to ban the entry into Ukraine of one thousand one hundred and thirty-sixty foreigners, a decision was made to force 101 alien-perpetrator to return and to expel 24 foreigners.

On April 2, 2019, in the course of joint activities, the employees of the Office of Migration Control, Counteraction to Illegal Migration and Readmission of the CMU of the LCC in Kyiv and the Kyiv Oblast, together with the employees of the State Enterprise BKOZ SBU during the development of one of the metropolitan markets, identified 18 foreigners who were on the territory of Ukraine violating the requirements of the current migration law.

Fifteen of the aforementioned foreigners were brought under the statutory administrative liability under Part 1 of Article 203 of the KUpAP, in relation to twelve of them, decisions were taken on forced return with the further prohibition of entry into the territory of Ukraine for a term of 3 years in accordance with the requirements of Article 26 of the Law of Ukraine "On the Legal Status of Foreigners and Stateless Persons". Also, for administrative liability under Art. 204 KUpAP attracted an employer, who, contrary to the requirements of the legislation, employed a foreigner. One foreigner has been shortened to stay in Ukraine.

Also, during the inspection, three illegal migrants were found who, within the established deadline, did not comply with the decision on compulsory returns of the said foreigners in accordance with the requirements of Part 2 of Art. 263 KUpAP was promptly detained and placed in Chernihiv TPPI of the LCI of Ukraine in order to prepare appropriate administrative lawsuits on detention and forced removal from Ukraine.

At the moment, the practical stage of the operation "Migrant" continues, the CMU of the LCC in Kyiv and the Kyiv region is planning and conducting further joint activities involving the relevant state bodies.
