Documents required for state registration of property rights for an object of incomplete construction

In accordance with Article 27-1 of the Law of Ukraine "On State Registration of Real Rights to Real Estate and its Limitations" for the state registration of ownership of an object of incomplete construction, the following documents shall be submitted:

a document certifying a real right to a land plot under such an object (in the absence of a registered right of ownership of a land plot in the State Register of Rights);

a document that, according to the law, grants the right to perform construction works (except when the registration of such a document was carried out in the Unified Register of documents giving the right to perform preparatory and construction works, certify the acceptance into operation of the objects completed by construction, information about the return to refinement, refusal to issue, cancellation and cancellation of the indicated documents);

a document that contains a description of the unfinished construction object based on the results of technical inventory of such an object.

For state registration of property rights to the unfinished construction object subject to privatization, the following documents are submitted:

a copy of the order of the State Property Fund of Ukraine to include the unfinished construction object in the list of state-owned objects subject to privatization;

a copy of the order of the state privatization body on the decision to privatize such an object;

a document that contains a description of the unfinished construction object based on the results of technical inventory of such an object.

State registration of ownership of an object of incomplete construction, acquired on the basis of an agreement, is carried out on the basis of such an agreement.

State registration of ownership of an object of unfinished construction on the basis of a court decision which has become legally valid is carried out in accordance with the rules specified by parts one to three of this article.

State registration of encumbrances for unfinished construction is carried out in accordance with the requirements established by part two of Article 27 of this Law.
